Terms of service

These terms are an agreement between you and VoxDuel covering the VoxDuel mobile app, this website, and any related services (together, the “Service”). By downloading, opening, or playing VoxDuel you agree to them. If you do not agree, please do not use the Service.

Our privacy policy explains how we handle your information and forms part of this agreement.

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian who agrees to these terms on your behalf. Local, pass-the-phone play requires no account and can be enjoyed by younger children on an adult’s device.

You can start playing as a guest. Online multiplayer and saved stats require an account. You are responsible for keeping your credentials secure and for activity that happens under your account.

• Provide accurate information and keep it current.
• Do not share your account or let anyone else use it.
• Do not create accounts to evade a suspension.
• Tell us promptly if you think your account has been compromised.

Display names are visible to other players. We may reclaim or change a display name that impersonates someone, infringes a trademark, or is offensive.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use VoxDuel for your own non-commercial entertainment. We keep all rights in the Service, including the software, the artwork, the category content, and the VoxDuel name and branding.

You agree not to:

• Cheat, use automation or scripts, or otherwise manipulate matchmaking, timers, or scores.
• Reverse engineer, decompile, or attempt to extract source code or content, except where that right cannot be excluded by law.
• Interfere with, overload, or probe our servers or networks.
• Harass, threaten, or abuse other players, including through display names or suggestions.
• Use the Service for anything unlawful, or to infringe anyone else’s rights.
• Resell, sublicense, or commercially exploit the Service or its content.

You can suggest category themes and vote on the weekly ballot. Only submit suggestions you have the right to submit, and do not submit anything confidential or anything that infringes someone else’s intellectual property.

By submitting a suggestion you grant us a worldwide, royalty-free, perpetual licence to use, adapt, and build on it in the Service without compensation or attribution. Ballots and vote tallies are advisory: we decide what actually gets built, and we may decline or withdraw any theme, including for rights or content reasons.

VoxDuel is free to download and play. If we introduce paid content or virtual items in the future, they will be sold through the Apple App Store or Google Play, and those platforms’ payment and refund policies will apply. Virtual items have no monetary value, cannot be exchanged for cash, and may be changed or discontinued.

We are actively developing VoxDuel. Features may be added, changed, or removed, servers may go down for maintenance, and some functionality depends on your network, your device, and third parties such as Chromecast or AirPlay. We do not promise uninterrupted or error-free operation.

We may update these terms. If a change is material we will give notice in the app or on this site before it takes effect, and continuing to use the Service after that means you accept the updated terms.

You may stop using the Service at any time and ask us to delete your account. We may suspend or terminate access if you breach these terms, if we are required to by law, or if we discontinue the Service. Sections that by their nature should survive termination will do so.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Speech recognition is probabilistic and will sometimes misrecognise an answer; that is a characteristic of the game, not a defect.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

To the fullest extent permitted by law, VoxDuel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty US dollars.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

You agree to indemnify and hold VoxDuel harmless from claims, losses, and expenses arising out of your breach of these terms or your misuse of the Service.

If you obtained VoxDuel from the Apple App Store, you acknowledge that this agreement is between you and VoxDuel only, and not with Apple. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for any product warranties, product liability claims, or third-party intellectual property claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you. You confirm you are not located in a country subject to a US Government embargo and are not on any US Government restricted-parties list.

These terms are governed by the laws of the United States, without regard to its conflict-of-law rules, and the courts there will have exclusive jurisdiction over any dispute — except that you may bring a claim in your local courts where consumer protection law gives you that right.
